The new Income Tax Act, 2025 replaces the 63-year-old Income Tax Act, 1961 from April 1, 2026. All old form numbers change. If your payroll software, TDS filing tool, or CA’s checklist still uses old form numbers after April 1 — there will be confusion and possible filing errors.
India’s government has released the Draft Income-tax Rules, 2026 — the rulebook supporting the new Income Tax Act, 2025. The biggest visible change for everyday people? All the form numbers you’ve used for years are getting new names.
Don’t worry — the rules themselves haven’t changed much. Tax rates are the same. Deductions are the same. Only the numbers printed on the forms are different. Think of it like a building that gets a new address — the building is the same, but you need to update your records.
📋 TDS & TCS Form Changes (Most Commonly Used)
These are the forms used by every employer, business, and individual who deducts or collects tax at source. This is the table to bookmark.
| What is the Form For? | Old Form | New Form | |
|---|---|---|---|
| TDS Certificate given to Employee (Salary) | Form 16 | → | Form 130 |
| TDS Certificate for Non-Salary payments (rent, professional fees) | Form 16A | → | Form 131 |
| TCS Certificate (Tax Collected at Source) | Form 27D | → | Form 133 |
| Quarterly TDS Return — Salary | Form 24Q | → | Form 138 |
| Quarterly TDS Return — Non-Salary (rent, contractor, professional) | Form 26Q | → | Form 140 |
| Quarterly TCS Return | Form 27EQ | → | Form 141 |
| Quarterly TDS — Payments to Non-Residents | Form 27Q | → | Form 144 |
| Annual Tax Credit Statement (Form 26AS) | Form 26AS | → | Form 168 |
🎯 The Big One: Form 16 → Form 130
Form 16 is the TDS certificate every salaried employee receives from their employer every year. It is used as proof of income and tax deducted when filing your ITR.
From April 2026, your employer will issue Form 130 instead. The content is exactly the same — only the form number changes. When you ask your employer for “Form 16” for FY 2026-27, they will give you Form 130.
🔍 Tax Audit Forms 3CA, 3CB, 3CD → Now Single Form 26
Currently, when a business gets a tax audit done by a CA, three separate forms are involved. The new rules merge all three into one single form — Form 26.
| What was it for? | Old Form | New Form | |
|---|---|---|---|
| Tax Audit Report (accounts audited under other law) | Form 3CA | → | Form 26 (all merged into one) |
| Tax Audit Report (accounts NOT audited under other law) | Form 3CB | → | |
| Statement of Particulars for Tax Audit | Form 3CD | → |
Why is this good news? Earlier, CAs had to figure out whether Form 3CA or 3CB applies to each client, then attach 3CD separately. Now it’s one unified Form 26 — less confusion, fewer errors.
📄 PAN & TAN Application Form Changes
| Purpose | Old Form | New Form | |
|---|---|---|---|
| Apply for a PAN (Permanent Account Number) | Form 49A | → | Form 4 |
| Apply for a TAN (Tax Deduction Account Number) | Form 49B | → | Form 14 |
